Course Overview

Trust accounting is one of the most important elements of practice management. The obligations and responsibilities of lawyers in this area are taken very seriously, and irregularities can lead to severe consequences. In this short course, we will outline the best practice trust accounting principles and the obligations of legal practitioners in respect of different types of trust money.

This course explains the basic requirements for dealing with trust money under the Legal Profession Uniform Law and explores some of the dangers that can result in trust account provisions being inadvertently breached. It identifies a range of best practice strategies, which may be implemented to prevent breaches, and considers the consequences when breaches do occur.

At the end of this course, you'll be able to:

  • Explain the regulatory framework governing trust money and record keeping.
  • Implement effective operating practices to comply with regulatory obligations and to rectify poor practices.
  • Outline the provisions governing the responsibilities of principal lawyers regarding trust monies.
  • Identify ways in which trust account provisions can inadvertently be breached and prevention strategies.

The course contains content that falls within the mandatory CPD categories of Ethics and Professional Responsibility and Practice Management and Business Skills.
